Documents needed to enact any construction works can be very different, depending on the circumstances (which are discussed further in the article). Here you will find a list of all the most common documents, which may be required, but it is strongly recommended to consult a real estate guidance agency before acquiring any of them in order to not waste your time on unnecessary preparations, or, to the contrary, be prepared inadequately for the project at hand.
- construction application with the following proofs of ownership as attachments (copies are permitted):
- excerpt from a Land Book
- border plan of the relevant land plot
- inventorization list of the property (a kind of technical assessment)
- approved construction project, which is compiled and approved on the basis of the following documents:
- topographic data of land plot (provided by private companies)
- technical plan of the building site (provided by private companies)
- architectural plan (scales M 1:250; M 1:500 or M 1:1000)
- expert assessment of the construction project (may be optional depending on the circumstances)
- land ownership proof
- contract with the chief architect of the projects
- author’s supervision journal (applicable when the project is constructed with the supervision of its author)
- construction works journal
- project insurance documents
In addition, permits from the following institutions may be required to receive an approval for the building project:
- Ministry of Environmental Protection and Regional Development (in Latvian: Vides aizsardzības un reģionālās attīstības ministrija)
- Riga Water Company (in Latvian: Rīgas ūdens) or its equivalent in another city
- State Fire and Rescue Service(in Latvian: Valsts ugunsdzēsības un glābšanas dienests)
Building parameters
As it was noted previously, there is a number of parameters determining the documents needed. This is why it is recommended to consider the following:
- Building type
There are three legally defined construction types in Latvia: Types I, II and III. Type I constructions specifically require the following documents:
- graphical representation of the building
- architectural plan (scales M 1:250; M 1:500 or M 1:1000), including the building’s relation to the relevant land plot
- ownership proofs for land and constructions, or a permission to use from their respective owners
- licences and permits if applicable
- other documents required by a specific Construction Board
Types II and III require the same documents, and additionally the following:
- detailed description of the project and its implementation details
- architectural plans of the individual floors and the roof, as well as groups of rooms if applicable
- facade information with height markings
- cross-sections with height markings
- if the construction project is to be completed in sections, then the information about the construction sequence and the scope of the sections
- Infrastructure
- If your project involves building a certain infrastructure, e.g. a canal, railroad, street, additional restrictions and requirements will apply
Other construction works
Construction works other than building, such as remodelling, restoration or demolishing, may require additional documents, depending on the process and its aims. Usually, these will be the same documents required for building, but with additional pieces of information about specific procedures or objects, e.g. if you are planning on remodelling a facade, a detailed description of the new facade, supplemented by by graphical solutions, may be required.
Temporary construction (including the process of building) is also a subject to modified document requirements. Depending on the circumstances, they may also be equal to the general rules for that particular project, but usually temporary construction works are legally made simpler.
Laws and regulations
As of 2018, there are three main pieces of legislation that define the document needed for any construction works:
- Construction law (In Latvian: Būvniecības likums)
- Building construction rules (In Latvian: Ēku būvnoteikumi)
- General construction rules (In Latvian: Vispārīgie būvnoteikumi)
The Construction law is the primary law in this regard, and the latter two are the Cabinet of Ministers regulations, issued in accordance with the said law.
